Agreement

These Terms of Use ("Terms") are a legal agreement between you and Assembly Labs, LLC ("we," "us," or "our") governing your use of the TOMO mobile application and related services (the "Service").

By downloading, accessing, or using TOMO, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. We've written this in plain language so you know exactly what you're agreeing to.

Apple is not a party to these Terms, but Apple and its subsidiaries are third-party beneficiaries of them and may enforce them against you. Apple's standard Licensed Application End User License Agreement also applies to your use of the app, and where the two conflict for App Store matters, Apple's terms control.

Eligibility

You must be at least 18 years old to use TOMO. By using the Service, you confirm that you are 18 or older. TOMO is not intended for, and may not be used by, anyone under 18.

The Service

TOMO is a training journal for Brazilian Jiu-Jitsu and related grappling arts. It comes in two plans.

Free costs nothing, for as long as you use it. On Free you can type a class in with every field (techniques, rounds, submissions, injuries, notes), keep your Journal and your whole history, see your Training Schedule and your stats, and use the Study video library and the starter picks. Nothing you log on Free is sent to a speech-to-text or AI provider.

Pro adds everything that runs on AI: logging a class by voice, the Sunday debrief written from your own classes, asking TOMO a question about your week, and video picks built for your week. Pro includes everything in Free.

We are continually improving TOMO. We may add, change, or remove features at any time, and we may set or change limits on certain features, with or without notice.

Your Account & Content

Your Account

• You are responsible for keeping your login credentials secure and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• Notify us promptly at the email below if you suspect unauthorized use of your account.

Your Content

Everything you log ("Your Content"), such as session notes, voice recordings, goals, and other journal entries, belongs to you. We do not claim ownership of it.

You grant us a limited license to store, process, and display Your Content solely to operate the Service for you: transcribing your recordings, generating your insights, and showing your history back to you. We never sell Your Content, and we never use it to train third-party advertising models. See the Privacy Policy for exactly how your data is handled.

Acceptable Use

When using TOMO, you agree not to:

• Break the law or infringe anyone's rights
• Upload content that is unlawful, harmful, or that you do not have the right to share
• Attempt to access, probe, or disrupt the Service, its servers, or other users' accounts
• Reverse-engineer, copy, or resell any part of the Service except as the law allows
• Use automated means to scrape or overload the Service

We may suspend or terminate accounts that violate these Terms.

Voice Recordings & AI Processing

Voice logging and the other AI features are part of Pro, including the 14 days of Pro every new account gets and Apple's free trial. When you use them, your audio is transcribed and your sessions are analyzed by third-party service providers, including speech-to-text and artificial intelligence providers, to provide the Service. On the Free plan, none of this processing happens. See the Privacy Policy for more information.

Subscriptions & Billing

TOMO is free to use. The Free plan costs nothing and has no time limit. TOMO Pro is an optional subscription that adds the features that run on AI, listed under The Service. Pro is available as a monthly plan at $3.99 a month and an annual plan at $29.99 a year, in US dollars; your App Store shows your local price, set by Apple. The founder plan is closed to new members (see below). Pro may not be offered in every version of the app or in every country; where it is not offered, everything in Free is still yours and nothing in this section applies to you.

• 14 days of Pro for every new account: When you finish setting up a new account, you get 14 days of Pro automatically. There is nothing to buy and nothing to enter: no payment method, no App Store purchase sheet, and nothing is charged when the days end. Each account gets these days once. When they end, your account becomes Free. Everything you logged stays, including classes you logged by voice and debriefs already written; only new AI work stops. Apple's free trial on Pro is a separate offer and remains available to you afterwards, once per Apple ID.
• Free trial: Pro's monthly and annual plans include a three-month free trial through Apple, offered once per Apple ID. It is separate from the 14 days of Pro every new account gets, and you can start it when those days end or at any later time. If you do not cancel at least 24 hours before the trial ends, your Apple ID account is charged the price of the plan you chose when the trial ends. Any unused portion of a free trial is forfeited the moment you purchase a subscription.
• Auto-renewal: Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
• Billing: All payments are processed by Apple through your App Store account. We do not process or store your payment information.
• Managing & canceling: You can manage or cancel your subscription at any time in your App Store account settings (Settings → your name → Subscriptions), after purchase. Canceling stops future renewals; you keep access to TOMO Pro through the end of the period you already paid for. When Pro ends, for any reason, your account becomes Free. Nothing you logged is removed, classes you logged by voice and debriefs already written stay readable, and only new AI work stops. Deleting the app does not cancel a subscription.
• Founder plan: The founder plan closed to new members on October 14, 2026. If you already hold it, nothing changes: your price is kept for as long as you stay subscribed and TOMO sells the plan, and you receive Pro's features as we release them, except that where a new feature carries a per-use cost to us, we may limit it or leave it out of the founder plan. Anyone who holds free access to TOMO through a separate program, such as a gym partnership, keeps that access on its own terms.
• Refunds: Purchases are handled by Apple and are subject to Apple's refund policies. To request one, visit reportaproblem.apple.com. We cannot issue refunds directly.

Plan pricing and offerings may change; any changes apply only to future billing periods, and we'll make material changes clear before they take effect. The one exception is the founder price for members already on the founder plan, which is kept as described under Founder plan above. What the Free plan includes may change for the future, but the Free plan has no time limit and we do not take away what you have already logged: your Journal and your history stay yours on every plan.

Disclaimers

Brazilian Jiu-Jitsu and grappling are physical contact activities that carry inherent risk of injury. TOMO is a journaling and informational tool only. It does not provide medical, health, fitness, or professional coaching advice, and nothing in the app should be treated as such. Consult a qualified instructor and, where appropriate, a medical professional before acting on anything in the app.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that insights will be accurate.

Limitation of Liability

To the fullest extent permitted by law, Assembly Labs, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service, including any injury sustained while training. Your sole remedy if you are dissatisfied with the Service is to stop using it.

Termination

You may stop using TOMO and delete your account at any time from Profile → Delete Account in the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as content ownership, disclaimers, and limitation of liability) will continue to apply.

Changes to These Terms

We may update these Terms to reflect changes to the Service, our practices, or legal requirements. When we make significant changes, we'll notify you through the app or by email. Your continued use of TOMO after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in Pennsylvania, except where applicable law provides otherwise.
