Agreement

These Terms of Use ("Terms") are a legal agreement between you and Assembly Labs, LLC ("we," "us," or "our") governing your use of the TOMO mobile application and related services (the "Service").

By downloading, accessing, or using TOMO, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. We've written this in plain language so you know exactly what you're agreeing to.

Apple is not a party to these Terms, but Apple and its subsidiaries are third-party beneficiaries of them and may enforce them against you. Apple's standard Licensed Application End User License Agreement also applies to your use of the app, and where the two conflict for App Store matters, Apple's terms control.

Eligibility

You must be at least 18 years old to use TOMO. By using the Service, you confirm that you are 18 or older. TOMO is not intended for, and may not be used by, anyone under 18.

The Service

TOMO is a training journal for Brazilian Jiu-Jitsu and related grappling arts. It lets you log sessions by voice or text, builds a searchable history of your training, and generates personalized insights and technique recommendations based on what you log.

We are continually improving TOMO. We may add, change, or remove features at any time, and we may set or change limits on certain features, with or without notice.

Your Account & Content

Your Account

• You are responsible for keeping your login credentials secure and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• Notify us promptly at the email below if you suspect unauthorized use of your account.

Your Content

Everything you log — session notes, voice recordings, goals, and other journal entries ("Your Content") — belongs to you. We do not claim ownership of it.

You grant us a limited license to store, process, and display Your Content solely to operate the Service for you: transcribing your recordings, generating your insights, and showing your history back to you. We never sell Your Content, and we never use it to train third-party advertising models. See the Privacy Policy for exactly how your data is handled.

Acceptable Use

When using TOMO, you agree not to:

• Break the law or infringe anyone's rights
• Upload content that is unlawful, harmful, or that you do not have the right to share
• Attempt to access, probe, or disrupt the Service, its servers, or other users' accounts
• Reverse-engineer, copy, or resell any part of the Service except as the law allows
• Use automated means to scrape or overload the Service

We may suspend or terminate accounts that violate these Terms.

Voice Recordings & AI Processing

When you use voice logging, your audio is transcribed and your sessions are analyzed by third-party processors (including AssemblyAI for transcription and Anthropic for insights) strictly to provide the Service.

Subscriptions & Billing

TOMO offers an optional subscription, TOMO Pro, that unlocks the app's full feature set. TOMO Pro is available as a monthly plan and an annual plan, and we may also offer a discounted founding-member monthly plan to early users. Prices for each plan are shown in the app and on the App Store at the point of purchase. TOMO Pro may not be offered in every version of the app or in every country; when it is not offered, the app is free to use and nothing in this section applies to you.

• Free trial: Eligible plans include a two-month free trial, offered once per Apple ID. If you don't cancel before the trial ends, payment is charged to your Apple ID account at confirmation of purchase, immediately following the trial period. Any unused portion of a free trial is forfeited the moment you purchase a subscription.
• Auto-renewal: Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
• Billing: All payments are processed by Apple through your App Store account. We do not process or store your payment information.
• Managing & canceling: You can manage or cancel your subscription at any time in your App Store account settings (Settings → your name → Subscriptions), after purchase. Canceling stops future renewals; you keep access to TOMO Pro through the end of the period you already paid for. Deleting the app does not cancel a subscription.
• Refunds: Purchases are handled by Apple and are subject to Apple's refund policies. To request one, visit reportaproblem.apple.com. We cannot issue refunds directly.

Plan pricing and offerings may change; any changes apply only to future billing periods, and we'll make material changes clear before they take effect.

Disclaimers

Brazilian Jiu-Jitsu and grappling are physical contact activities that carry inherent risk of injury. TOMO is a journaling and informational tool only. It does not provide medical, health, fitness, or professional coaching advice, and nothing in the app should be treated as such. Consult a qualified instructor and, where appropriate, a medical professional before acting on anything in the app.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that insights will be accurate.

Limitation of Liability

To the fullest extent permitted by law, Assembly Labs, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service — including any injury sustained while training. Your sole remedy if you are dissatisfied with the Service is to stop using it.

Termination

You may stop using TOMO and delete your account at any time from Profile → Delete Account in the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as content ownership, disclaimers, and limitation of liability) will continue to apply.

Changes to These Terms

We may update these Terms to reflect changes to the Service, our practices, or legal requirements. When we make significant changes, we'll notify you through the app or by email. Your continued use of TOMO after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in Pennsylvania, except where applicable law provides otherwise.
